Pierce Warns Crypto Vaults and Lending Strategies May Still Fall Under SEC Jurisdiction
SEC Commissioner Hester Peirce has issued a statement on crypto vaults and lending strategies, warning that putting an activity on-chain does not automatically move it outside federal securities laws.
Pierce's July 22 statement, titled 'Headstands and Summervaults: A Statement on Crypto Vaults and Lending Strategies,' argues that decentralization claims need to match how the product actually works.
The commissioner is often viewed as one of the SEC's more crypto-friendly voices, but this statement is not a free pass. It is a warning that decentralization does not automatically exempt products from securities laws.
According to Peirce, regulators look at more than just code; they examine who controls the strategy, makes decisions, and relies on users, as well as how returns are generated and whether investors expect profit from someone else's efforts.
