Regulatory Uncertainty Hits Institutional Demand for Bitcoin

Institutional investors are reportedly reducing their exposure to Bitcoin via spot exchange-traded funds (ETFs), which have seen significant outflows totaling approximately $332 million across September 8-10. This pullback coincides with growing anticipation of a pivotal US Senate cloture vote on the Digital Asset Market Clarity Act (CLARITY Act) scheduled for September 15.
The CLARITY Act, which passed the House earlier this year, aims to clarify the regulatory landscape by delineating jurisdiction between the Commodity Futures Trading Commission (CFTC) and the Securities and Exchange Commission (SEC) over digital assets. Meanwhile, the SEC has advanced its own regulatory proposal, dubbed 'Regulation Crypto Assets,' which seeks to tailor offering and disclosure requirements specifically for crypto assets.
The dual-track regulatory approach is creating a tension point for institutional investors, who are weighing the potential benefits of clearer guidance against the risks of increased compliance burdens.
