The move comes after a recent interview with CEO Brad Garlinghouse and Chief Legal Officer Stuart Alderoty, who expressed confidence in winning the appeal. The Second Circuit has a history of skepticism towards the SEC and regulatory overreach, which may work in Ripple's favor.

Alderoty noted that reversing a loss in this court is low, but he believes the ruling will not only uphold Judge Torres' decision but strengthen it. Garlinghouse emphasized that a favorable outcome would significantly undermine SEC Chair Gary Gensler's regulatory agenda.
