Ripple's Path Forward: Beyond the CLARITY Act
Ripple's push to expand its institutional ambitions is not dependent on the passage of the CLARITY Act, according to top researcher SMOKE. The bill, which aims to establish a broader regulatory framework for digital assets, has faced delays in the U.S. Senate and may not provide the clarity that the industry needs.
The OCC charter conditionally approved by Ripple National Trust Bank in December 2025 offers an alternative path forward. This federally supervised banking structure could strengthen Ripple's position with financial institutions and regulated businesses, particularly in custody, stablecoin operations, and RLUSD reserve management.
SPECIFICALLY, the OCC charter could provide Ripple with a company-specific regulatory pathway that complements or potentially even precedes federal legislation. If Congress continues to struggle with the CLARITY Act, this path could become increasingly important for Ripple's growth.
