SEC Can Start Crypto Rulemaking Without Waiting for Clarity Act, Former Official Says

A former U.S. Securities and Exchange Commission (SEC) official has stated that the agency can initiate rulemaking for digital assets without waiting for the passage of the CLARITY Act.

Anne Kelly emphasized in a post on X that the SEC can proactively begin rulemaking, which would be incorporated into additional rule proposals if the CLARITY Act is later enacted.

This approach could accelerate regulatory clarity for the cryptocurrency industry, as market participants have long sought clear guidelines on how digital assets are classified and regulated.
