SEC Can Start Crypto Rulemaking Without Waiting for CLARITY Act Passage
Former SEC official Anne Kelly has stated that the U.S. Securities and Exchange Commission (SEC) can initiate rulemaking for digital assets without waiting for the passage of the CLARITY Act.
Kelly emphasized that the SEC has existing authority to propose rules for digital assets, and any later legislative changes can be incorporated through additional rule proposals.
This approach could potentially accelerate regulatory clarity in the cryptocurrency industry, which has long sought clear guidelines on how digital assets are classified and regulated.
According to Kelly, regulators have the tools to begin shaping the framework now, even if the CLARITY Act is later enacted.
