SEC Pause Hits Nasdaq's Bitcoin Derivatives Plans
The US Securities and Exchange Commission (SEC) has paused the launch of Bitcoin derivatives on Nasdaq's QBTC options due to regulatory challenges. The move, effective July, follows a jurisdictional dispute between the SEC and CME Group over who oversees Bitcoin derivatives.
In May 2026, the SEC granted conditional approval for these options, which are meant to track the Nasdaq Bitcoin Index. However, CME challenged this decision, arguing that Bitcoin is a commodity rather than a security and therefore falls under the Commodity Futures Trading Commission's (CFTC) regulations.
The SEC's review will determine whether the QBTC options should be subject to SEC or CFTC oversight. If Nasdaq needs to apply for CFTC registration, it could significantly impact the launch timetable. Alternatively, Nasdaq might attempt to restructure the product to comply with SEC guidelines, but this is unclear.
