SEC Prepares to Enact Crypto Rules Without Congressional Approval

SEC Chair Paul Atkins has vowed to move forward with crypto market rules if Congress fails to pass the Clarity Act. The act, which would provide a more durable framework for crypto regulation, has stalled in the Senate Banking Committee.

The SEC's own rulemaking package, announced as Project Crypto last November, covers token registration exemptions and safe harbor provisions for decentralized projects. This package is already complete and ready to be implemented if needed.

Atkins emphasized that while legislation remains the preferred path for creating a durable regulatory framework, he is committed to supporting Congress in advancing the Clarity Act. However, he is not waiting on Capitol Hill to act, stating that the SEC is prepared to issue its own rules under existing authority if necessary.
