SEC Prepares to Write Own Crypto Rules If Clarity Act Fails
The US Securities and Exchange Commission (SEC) has expressed its support for the CLARITY Act, a regulatory framework aimed at providing clarity for the digital asset market. SEC Chairman Paul Atkins stated that he is committed to supporting Congress in advancing the bill.
If the bill fails to pass, the SEC is prepared to draft its own rules for the digital asset market. This comes as the CLARITY Act faces a tight window for approval before the August recess, with hopes of a cloture vote this week fading.
The House passed its version of the bill in 2025 with strong bipartisan support, while the Senate Banking Committee advanced its version in May 2026 by a 15-9 vote. However, a final agreement has not yet been reached due to disagreements over ethics provisions and state enforcement roles.
