SEC Publishes Proposed Crypto Rules with Potential Exemptions
The Securities and Exchange Commission (SEC) has published its proposed Regulation Crypto Assets framework in the Federal Register, kicking off a 60-day public comment period.
The proposal, which has been eagerly anticipated by the crypto community, includes possible exemptions for covered digital asset investment contracts. One of these exemptions would allow startups to raise up to $5 million without violating securities laws, while another exemption would permit companies to raise up to $75 million over a 12-month period.
The SEC's proposal is not yet final and is subject to change based on public feedback. In fact, the agency has emphasized that the proposed exemptions are not a guarantee of approval for all token sales. Instead, they represent a potential framework for compliant fundraising in the US.
Crypto builders and investors will have until October 20 to weigh in on the proposal, which could have significant implications for the industry as a whole. The SEC's goal is to create a more predictable path for token issuance while maintaining basic protections for investors.
