SEC Pushes Forward on Crypto Rules Amid Clarity Act Stalemate
The SEC has proposed its own framework for crypto asset offerings, moving forward despite the stalled Clarity Act.
The new rules aim to bring clarity and onshore innovation in the crypto market, according to SEC Chairman Paul Atkins.
The proposal includes two exemptions from registration under the Securities Act of 1933. The first allows issuers to raise up to $5 million over four years, while the second permits up to $75 million in any 12-month period with financial statements and ongoing reporting obligations.
The rules also offer a conditional safe harbor, which could remove tokens from the securities definition after promised managerial work is completed.
