SEC Reviews Automatic Filing Pathways for Exotic Crypto and Event-Linked ETFs

The Securities and Exchange Commission (SEC) is reviewing automatic filing pathways for exchange-traded funds (ETFs) after proposals for exotic crypto and event-linked ETFs flooded the market. The SEC's June 30 request for public comment covers various types of assets, including crypto assets, commodities, heightened gearing, single-stock products, blockchain-based opportunities, private assets, and event contracts.

The review is a response to the rapid growth of the ETF industry, with assets in US ETFs climbing from over $4 trillion at the end of 2019 to over $12 trillion by the end of 2025. The product count has also increased significantly, rising from almost 1,900 to more than 4,600 during the same period.

The SEC is examining whether its existing rules give staff enough time and authority to assess products whose economic behavior can differ sharply from traditional diversified funds. The review is not limited to a single application but rather looks at the broader implications of the ETF industry's growth.
