SEC Scrutinizes Automatic Filing Pathways for ETFs Amid Exotic Crypto and Event-Linked Proposal Surge

The Securities and Exchange Commission (SEC) is reviewing the automatic filing pathways for exchange-traded funds (ETFs) after a surge in exotic crypto and event-linked ETF proposals flooded the market. The review comes as the SEC examines whether its existing rules give staff enough time and authority to assess products whose economic behavior can differ sharply from traditional diversified funds.

The number of US ETFs has skyrocketed, with assets climbing from over $4 trillion at the end of 2019 to more than $12 trillion by the end of 2025. The product count rose from almost 1,900 to over 4,600 during the same period.

Crypto products, in particular, have changed the landscape. Spot Bitcoin and Ethereum products are now registered under the Securities Act of 1933, while traditional ETFs are registered under the Investment Company Act of 1940. This has led to a blurred line between different legal categories, making it harder for investors to understand what they're buying.

The SEC is reviewing how far the distribution system can stretch, examining whether its existing rules give staff enough time and authority to assess products with unique economic behavior. The review will cover various categories, including crypto assets, commodities, heightened gearing, single-stock products, blockchain-based opportunities, private assets, and event contracts.
