SEC Sees Opportunity in CLARITY Act Failure, Fast-Tracks Crypto Regulations
The SEC may gain more freedom to regulate cryptocurrencies under President Trump's administration if the CLARITY Act fails to pass in Congress, according to Nate Geraci, an ETF expert.
Geraci pointed out that this bill could have an unexpected effect on the industry: giving the SEC the ability to fast-track crypto regulations via existing laws. He noted that a new administration may undo some of the changes made by the SEC, but the rapid evolution of the crypto market may make it difficult to unwind those changes.
The SEC is already taking steps to implement its own crypto plan, with an open meeting scheduled for Friday to discuss proposed rules for establishing a 'tailored offering' framework for crypto investment contracts. The proposal would further the agenda of the SEC's Regulation Crypto Assets (Reg Crypto) plan to regulate cryptocurrencies and crypto-related services.
