SEC Set to Consider Proposal for Regulating Cryptocurrency Offerings
The US Securities and Exchange Commission (SEC) is set to consider a proposal for regulating cryptocurrency offerings at a public meeting on Friday. The move could be a significant step towards clarifying how digital asset investments are regulated in the country.
According to Jaret Seiberg, managing director at TD Cowen's Washington Research Group, the SEC may propose a tailored offering regime for crypto-related investment contracts. This framework would introduce a safe harbor allowing token sales during early development without treating tokens as securities.
The proposed rules are expected to provide a clear route for issuers to raise capital through an investment contract while avoiding the burdensome securities regime and litigation risk. Seiberg notes that this approach could let issuers offer products without having to choose between these two options.
Any approved proposal would not be final but would trigger publication of draft rules and fact sheets, offering early insight into upcoming crypto disclosure standards.
