SEC Set to Greenlight Historic Crypto Rulemaking on August 14
The Securities and Exchange Commission (SEC) is set to vote on August 14, 2026, on its first major rulemaking for crypto assets. The proposal, called Regulation Crypto, aims to create a tailored offering regime for certain investment contracts involving crypto assets.
The SEC's three-member commission is expected to green-light the step of publishing the proposal and opening it for public comment. This would be a significant development in the regulatory landscape for cryptocurrencies, as it would provide clarity on how they are treated under securities law.
The Regulation Crypto framework, laid out by Chairman Paul Atkins in March, would give crypto projects a route to raise capital without triggering full securities registration, and an exit path out of SEC jurisdiction once a team is no longer actively managing the network. However, the details of the proposal are not yet public, and it's unclear what specific changes it would make.
The SEC's move has been seen as a way to deliver certainty after the Senate stalled on passing the CLARITY Act, which aimed to provide regulatory clarity for crypto assets. Analysts believe that this rulemaking is just the first of several that the agency will undertake in the coming months.
