SEC Shifts Gears on Crypto Enforcement
The SEC has taken deliberate steps to dismantle the Biden administration's crypto enforcement strategy and replace it with a more industry-friendly approach. The Trump-era SEC has dismissed several high-profile cases against major crypto firms, including Coinbase, Binance, and Kraken, and is instead focusing on clear instances of fraud rather than broad jurisdictional claims.
The agency has also rescinded Staff Accounting Bulletin 121 (SAB 121), a guidance that made crypto custody so capital-intensive that most banks refused to touch it. In its place, the SEC has established a Crypto Task Force led by Commissioner Hester Peirce and announced 'Project Crypto,' an initiative aimed at modernizing securities rules for on-chain market activities.
The proposed regulatory framework is designed to clarify how crypto asset issuers and market participants fit under federal securities laws. SEC officials have framed this effort as a 'reshoring' strategy, arguing that aggressive enforcement during the Biden years pushed companies overseas but didn't eliminate crypto activity.
