SEC's Peirce: Crypto Reform Will Continue Even if CLARITY Act Falters
SEC Commissioner Hester Peirce is optimistic that the CLARITY Act can pass in Congress, but she believes that regulatory reform does not have to wait for its completion. According to a report published on August 5, Peirce thinks the SEC has significant authority to clarify token classifications, create fundraising exemptions, and modernize rules for trading, custody, and tokenized securities.
The CLARITY Act aims to provide a durable market structure by defining the responsibilities of the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC). However, its path through the full Senate has been complicated by disagreements over political ethics, stablecoin rewards, and the regulation of decentralized finance.
Pierce points out that even if the CLARITY Act stalls, the SEC can still take action to reduce uncertainty in the crypto market. The agency's Crypto Task Force, led by Peirce, has an explicit mandate to distinguish securities from non-securities and create tailored disclosure frameworks. It can also issue interpretations, propose formal regulations, grant limited exemptions, and publish guidance explaining how existing requirements apply to new technology.
