Senate Republicans Strip Blockchain Developers of Explicit Criminal Protections

The Blockchain Regulatory Certainty Act (BRCA) has undergone significant changes after Senate Republicans released a revised draft of the Digital Asset Market Clarity Act, also known as the CLARITY Act (H.R. 3633), on September 13.

The new draft incorporates 126 changes requested by Democrats and represents a carefully negotiated compromise to achieve bipartisan support for the legislation.

One of the most notable changes is the removal of explicit criminal protections for blockchain developers, miners, and validators from the original BRCA language.

This change has sparked concerns among industry observers that without these protections, developers will remain in a gray zone where prosecutorial discretion determines their fate.
