Sheriffs vs Blockchains: CLARITY Act Provisions Cause Rift Between Law Enforcement and Industry

The CLARITY Act's decentralized finance (DeFi) provisions have sparked controversy among law enforcement and industry groups. The National Sheriffs' Association has renewed its opposition to the bill, warning that it would create broad exemptions from registration, know-your-customer, anti-money-laundering, and sanctions-law requirements for DeFi participants.

The association's main concern is Section 604 of the bill, which shields non-custodial software developers. Lindsay Fraser, chief policy officer at the Blockchain Association, disagrees with this reading, calling it a 'fundamental misunderstanding' of what the provision actually does.

Fraser argues that Section 604 prevents non-custodial software developers from being misclassified as money transmitters when they do not custody assets or control transactions. She also claims that the provision does not immunize criminals, limit sanctions enforcement, or stop prosecutions for money laundering, fraud, or terrorist financing.

The dispute has become a subplot in the broader Senate fight over the CLARITY Act. The law enforcement community is far from unified on the provision, with some groups opposing it and others supporting it. The National Organization of Black Law Enforcement Executives has endorsed the bill, while Major County Sheriffs of America has shifted from active opposition to neutral on Section 604.
