South Africa Cracks Down on Cross-Border Crypto Transactions with New Regulatory Framework

South Africa has introduced a new regulatory framework for cross-border cryptocurrency transactions. The framework requires that international digital asset transfers use authorized service providers and include notifications to the nation's central banking authority.

The National Treasury and South African Reserve Bank released the draft Crypto Asset Manual, which outlines specific circumstances under which digital currency transactions become subject to cross-border regulatory requirements. Under the proposed rules, a reportable transaction would be triggered when cryptocurrency transfers from a locally authorized provider to an international platform or into self-custodial wallets controlled privately by individuals.

Authorized service providers would bear responsibility for submitting these inbound and outbound transaction records to the Financial Surveillance Department. Transactions involving purchases or sales denominated in rand through locally authorized providers would not constitute offshore movements, as South Africa is effectively creating a distinction between domestic market operations and transfers that move value outside national financial oversight mechanisms.

The regulatory structure would mandate that users complete all international cryptocurrency transfers exclusively through authorized crypto asset service providers. Regulatory authorities would obtain transaction data through established foreign exchange surveillance infrastructure, aiming to eliminate regulatory blind spots and enhance identification of illegal financial movements.
