South Africa Unveils Draft Crypto Cross-Border Rules Amid Regulatory Push

South Africa has published draft guidelines for cross-border cryptocurrency transactions as part of its efforts to bring crypto into its financial rulebook. The National Treasury and the South African Reserve Bank jointly released the Crypto Asset Manual, which outlines when moving crypto across borders becomes a regulated and reportable event.

The proposed rules are designed to prevent crypto assets from being used as a backdoor around South Africa's existing financial controls and help authorities detect and disrupt illicit financial flows. According to the guidelines, a crypto transaction only becomes a cross-border event when assets move from a local authorised Crypto Asset Service Provider to an offshore provider or into a private non-custodial wallet.

The rules also limit individuals' ability to move crypto assets offshore, requiring them to do so through an authorised provider and reporting the transaction to the Reserve Bank's Financial Surveillance Department. Major banks in South Africa are already developing crypto products for institutional clients, while hundreds of licensed virtual asset service providers operate in the country.
