South Africa's Bitcoin Transfer Ruling Creates Regulatory Whiplash
South Africa's cryptocurrency users and investors are facing a complex legal landscape due to competing court rulings on Bitcoin transfers. In May 2025, the Gauteng High Court in Pretoria ruled that crypto does not fall under exchange control regulations, but this decision was appealed and remains technically ineffective.
The Johannesburg High Court later issued a contradictory ruling in June 2026, deeming Bitcoin as both money and capital under exchange control law. This effectively invalidated the previous 'precedent', establishing that crypto transfers may violate South Africa's capital movement restrictions.
For ordinary citizens and businesses, this duelling verdicts create a genuine dilemma. Those who have already moved cryptocurrency holdings to foreign platforms may inadvertently have violated exchange control rules, depending on which court's interpretation ultimately prevails.
The regulatory authorities are preparing to scrap the existing Exchange Control Regulations and replace them with streamlined Capital Flow Management Regulations. The draft version of these new regulations explicitly defines crypto assets as capital and subject to regulation, excluding them from the definition of currency.
