South Africa's Crypto Community Hit with Regulatory Whiplash

South Africa's cryptocurrency community is facing a complex and shifting legal landscape due to two contradictory High Court decisions.

The first ruling, delivered in May 2025 by the Gauteng High Court in Pretoria, stated that cryptocurrency transfers do not fall under the country's exchange control framework.

However, this decision was appealed, leaving it technically ineffective while the appeal process continues.

In June 2026, the Johannesburg High Court arrived at the opposite conclusion, ruling that Bitcoin qualifies as both money and capital under exchange control law.

This has left ordinary South Africans and businesses with a dilemma, as those who have already moved cryptocurrency holdings to foreign platforms may inadvertently have violated exchange control rules.
