Stablecoin Issuance: Banks Must Navigate Complex Regulatory Landscape

When it comes to issuing stablecoins, banks face numerous decisions that require careful consideration of regulatory frameworks, balance sheets, and ownership structures. The European Union's Markets in Crypto-Assets (MiCA) framework provides a clear set of rules for issuers, but the type of digital instrument issued can significantly impact the bank's operations.

The first decision is whether to issue an e-money token (EMT), which represents electronic money denominated in a single official currency and must be redeemable at par value. For banks already authorized as credit institutions, MiCA provides a route to issue EMTs without separate authorization, subject to certain requirements.

The choice of instrument has significant implications for balance-sheet architecture, with EMTs introducing new regulatory and reserve frameworks. Banks should prioritize the selection of blockchain infrastructure, which determines switching costs and interoperability for up to a decade.

Governance structures are also crucial, as they determine who bears liability, controls minting authority, and is accountable to regulators. Smart contract design should incorporate compliance controls, including address blocking for sanctions compliance and emergency pause mechanisms.
