Crypto.com and Robinhood are seeking clarity from the US Supreme Court (SCOTUS) on whether federal law supersedes state regulations for prediction markets. The companies have filed petitions with SCOTUS, citing the Commodity Exchange Act (CEA) as a potential shield against state oversight.

The CEA defines 'swap' as a contract dependent on an event or contingency associated with a financial consequence, which some predict market operators believe applies to their sports event contracts. However, states argue that this interpretation undermines their regulatory authority over wagering.

SCOTUS has not yet confirmed whether it will hear the case, but industry experts speculate that a decision could come as early as November or by the end of 2027.
