The CLARITY Act aims to divide federal oversight of digital assets between the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC). Ethics language has been a sticking point, with Democrats arguing for limits on officials' ability to issue or sponsor digital assets.
A working draft of the ethics section bars public officials and employees from issuing digital assets while in office but allows them to hold and invest in crypto. It also assigns enforcement to the Department of Justice (DOJ) without independent authority for state attorneys general.
