$TRUMP Memecoin Halts Clarity Act Progress Over Ethics Concerns
The Clarity Act, aimed at bringing regulatory clarity to the crypto industry, has stalled in Congress due to an ethics provision related to President Trump's memecoin, $TRUMP.
The bill would define which digital assets fall under SEC jurisdiction and which belong to the CFTC, but its progress has been hindered by disagreements over whether the president should be allowed to profit from his own token while his appointees regulate the industry.
The Clarity Act proposes a functional test for determining a token's regulatory classification, with tokens that are sufficiently decentralized classified as digital commodities and regulated by the CFTC, and those that function as investment contracts remaining securities under SEC jurisdiction.
The bill also creates registration pathways for crypto exchanges, sets disclosure requirements for token issuers, and provides a framework for stablecoin oversight.
