Trump Tariffs Ruled Unconstitutional, Companies Get Billions Back
The US Supreme Court's ruling in February 2026 declared President Trump's tariffs unconstitutional, and now companies are getting billions back from the invalidated levies.
Amazon received approximately $600 million in tariff refunds in the second quarter of 2026 alone, while Williams-Sonoma collected $200 million and used some of it to fund employee pension contributions. Shipping giants FedEx, UPS, and DHL are also pursuing their own refund claims, promising to pass the benefits on to customers.
However, lawsuits have been filed against these companies, arguing that they should be required to return the money directly to consumers who paid tariff surcharges at the point of shipment. The refund pipeline runs through a system called CAPE, operated by Customs and Border Protection, which has already distributed tens of billions of dollars.
Some companies have explored selling their refund rights to third parties at a discount, accepting $0.80 for every dollar they're owed, in exchange for certainty and speed.
