Trump's CFTC Rebuild: A Mixed Bag for Crypto
The Commodity Futures Trading Commission (CFTC) is being rebuilt under President Donald Trump's administration, but it may not favor the crypto industry.
The White House has vetted candidates for all four vacant CFTC seats, including two Democrats, but a president's party traditionally takes the majority by custom rather than statute. This means that three Republicans and two empty chairs would satisfy the law completely.
The current chairman, Michael Selig, is alone in voting on decisions after the departure of Commissioners Rostin Behnam, Kristin Johnson, Christy Goldsmith Romero, Summer Mersinger, and Caroline Pham. The last full CFTC was a Democratic majority that included Behnam, who asked Congress for spot authority over digital commodities.
The crypto industry prefers an arithmetic outcome, where Selig plus two Republicans hold the majority, and moderates take the two minority seats. However, two Democrats could still force cost-benefit analysis, stretch comment periods, and slow approvals on perpetual futures and margin.
