US Lawmakers Unveil Clarity Act to Regulate $2 Trillion Digital Asset Industry
The US digital asset industry has grown significantly over the past decade, with cryptocurrencies reaching a market value of over $2 trillion. However, regulatory uncertainty has plagued the sector, leading to repeated legal disputes between regulators and companies.
The Securities and Exchange Commission (SEC) and Commodity Futures Trading Commission (CFTC) have clashed over how digital assets should be classified, with the SEC arguing that many should be treated as securities and the CFTC believing they function more like commodities.
To address these challenges, lawmakers introduced the Digital Asset Market CLARITY Act, which aims to establish a federal regulatory framework for digital assets. The bill clarifies how existing financial laws apply to digital assets and defines the responsibilities of the SEC and CFTC.
Supporters argue that the legislation provides greater regulatory certainty, encouraging innovation and protecting investors. Critics, however, believe some parts may weaken investor safeguards or leave gaps in oversight.
The bill distinguishes between securities, digital commodities, payment stablecoins, and decentralized networks, addressing a significant challenge in the sector: decentralized finance (DeFi). The legislation introduces legal tests to determine whether a blockchain network is genuinely decentralized, which could impact how projects are regulated.
