Winklevoss Warns Against Post-Gensler Crypto Regime
Tyler Winklevoss has called for crypto regulations to be established under SEC Chairman Paul Atkins and CFTC Chairman Brian Selig, rather than left to a future administration. He argues that this will prevent a repeat of the 'regulation by litigation' strategy employed during former SEC Chair Gary Gensler's tenure. This approach left exchanges and token issuers operating in uncertainty, with unclear guidelines on which digital assets qualify as securities.
The CLARITY Act aims to draw a clearer line between the SEC's and CFTC's authority over digital assets. If passed, it would clarify the central jurisdictional question of whether a given token is a commodity or a security. The Senate and industry groups are still deliberating over its provisions.
Selig has committed to finalizing digital asset regulations before the current administration ends, indicating a sense of urgency inside the CFTC. Joint rules from the SEC and CFTC could be issued even if the CLARITY Act fails to pass. President Trump has met with both Atkins and Selig to discuss the potential implementation of the bill.
