WSJ Editorial Board Slams Clarity Act Over Regulatory Loopholes

The Wall Street Journal Editorial Board has criticized the proposed Clarity Act, which aims to provide regulatory certainty for the cryptocurrency industry. The board acknowledged that the legislation would create clearer rules distinguishing digital assets regulated by the Securities and Exchange Commission from those falling under the Commodity Futures Trading Commission.

However, the editorial also raised concerns over potential risks to the U.S. financial system. It claimed that the bill creates a loophole allowing crypto exchanges to offer 'rewards' to stablecoin holders, despite the prohibition on issuers paying interest by the GENIUS Act. This could encourage depositors to move funds out of traditional banks.

The editorial also expressed concerns over anti-money laundering (AML) and know-your-customer (KYC) requirements. Exempting certain decentralized networks from these rules could create opportunities for illicit finance, according to the board.

Lawmakers were urged to tighten the language to close perceived loopholes before sending the legislation to President Donald Trump's desk. The editorial was met with criticism from crypto luminaries, including DeFi Education Fund CEO Neeraj Agrawal and Blockchain Association CEO Ji Kim.
