XRP Unfazed by CLARITY Act Delay Amid Regulatory Advantage
The proposed CLARITY Act, designed to clarify regulatory oversight of digital assets in the US, has been delayed. However, XRP has shown a relatively muted response to this uncertainty.
XRP traded near $1.40 while traders maintained billions of dollars' worth of derivatives positions open. This lack of reaction is significant because XRP already has a unique advantage in terms of regulatory clarity.
Ripple and the SEC had concluded their appeals in August 2025, effectively ending the high-profile case that began in 2020. The final judgment imposed a $125 million penalty on Ripple for institutional sales, while an earlier ruling found that programmatic XRP sales on exchanges did not constitute unregistered securities offerings.
The CLARITY Act would create a market structure extending far beyond Ripple's case. A planned procedural vote had been scheduled for September 15 but has since been delayed. The Senate path is increasingly uncertain, and the legislation may face further revisions before reaching the president.
