Delaware Joins Coalition Challenging Trump Tariffs on 80 Countries

Delaware Attorney General Kathy Jennings has joined a coalition of attorneys general in filing a lawsuit against the Trump administration's latest tariffs on over 80 countries. The tariffs, which were imposed after an investigation by the United States Trade Representative, are being challenged as exceeding the administration's legal authority and violating the Administrative Procedure Act.

The lawsuit, filed in the U.S. Court of International Trade, follows two previous legal challenges to tariffs imposed by the Trump administration. In February, the Supreme Court rejected the administration's use of the International Emergency Economic Powers Act to impose tariffs, and in May, the U.S. Court of International Trade ruled that tariffs imposed under Section 122 of the Trade Act of 1974 were unlawful.

The coalition of attorneys general argues that the latest tariffs will increase costs for states and consumers, with nearly 90% of the costs being paid by American consumers and businesses, according to an analysis by researchers at the Federal Reserve Bank of New York. The lawsuit joins 22 other states, including Oregon, Arizona, and California, in challenging the administration's actions.
