Fed Unveils Rules Aimed at Revitalizing Struggling Mutual Banking Sector

The mutual banking sector has been steadily eroding for decades, with hundreds of depositor-owned institutions converting to stock ownership. However, industry leaders believe that a new package of proposed rules from the Federal Reserve could provide a lifeline and revitalize the sector.

Kip Weissman, a partner at Luse Gorman, described the proposal as an 'earthquake' and 'stunning in its breadth.' The 150-page document aims to broaden depositor-owned banks' access to capital by streamlining the process for waiving dividends that would be paid to the institution.

The proposed rules also ensure that special deposits and mutual capital certificates are treated as regulatory capital, including Common Equity Tier 1 capital in some instances. This is a significant change from the current framework, which has remained largely unchanged since 1993.

Credit unions may also be prompted to consider converting charters under the proposed rules, according to Weissman and Tom Fraser, CEO of First Mutual Holding Company. The industry is hailing the proposal as 'smart regulation' and a long-overdue step to ensure that mutuals can continue to thrive in the banking system.

The Federal Reserve is accepting comments on the proposed rule changes through October 5.
