Ripple's RLUSD Stablecoin Complies with Strict Oversight

The stablecoin market is often marked by confusion over regulatory compliance. Different licenses and charters can provide varying levels of oversight, capital requirements, reserve rules, and consequences for issuers who fail. For institutions looking to hold, settle, or build on a stablecoin, understanding these distinctions is crucial.

There are three primary types of oversight for U.S.-based issuers: money transmitter licenses (MTLs), state trust company charters, and federal prudential oversight under the GENIUS Act. MTLs regulate money transmission and stored value but do not specifically address stablecoin issuance, leading to inconsistent requirements across states.

State trust company charters, such as those overseen by the New York Department of Financial Services (NYDFS), provide more comprehensive oversight, extending to reserve composition, segregation, independent attestations, and review of technology and operational flows. Reserves must be held in permitted assets like cash, short-dated U.S. Treasuries, and Treasury-backed repo.

The GENIUS Act created a federal framework for 'permitted payment stablecoin issuers' above $10 billion to be supervised directly by the OCC, FDIC, or Federal Reserve. Below this threshold, issuers can operate under qualifying state regimes.
