Amgen Seeks Fourth Circuit Ruling on CareFirst Biosimilar Lawsuit

Amgen has urged the Fourth Circuit to dismiss CareFirst's lawsuit accusing it of unlawfully delaying biosimilar competition for Enbrel. The health insurer alleges that Amgen engaged in anticompetitive conduct, but Amgen argues that its actions were lawful.

The lawsuit, which was filed in Virginia federal court, centers on the timing of biosimilar versions of Enbrel, a popular rheumatoid arthritis treatment. CareFirst claims that Amgen's efforts to delay competition for Enbrel have caused significant harm to consumers and the healthcare system as a whole.

In its appeal, Amgen argues that the district court erred in denying its motion to dismiss the lawsuit. The company maintains that it has not engaged in any anticompetitive conduct and that the allegations against it are without merit.
