ATO Tax Ruling Hits US Tech Giants with Royalty Withholding
The Australian Taxation Office has released a final tax ruling that classifies software and digital streaming fees as royalties. This means offshore revenue transfers from US tech giants operating in Australia are now taxable.
The new policy could extract billions of dollars from companies like Amazon, Alphabet, Microsoft, Apple, Spotify, and Netflix, which operate cloud computing services and digital media platforms in the country.
Australia's tax liability for these firms will be based on a 5% withholding tax rate on gross payments without cost deductions. If payments are routed through financial hubs like Singapore, the tax rate will be 10%.
This ruling may create two critical risks for multinationals: maintaining global consistency of their tax positions and facing double taxation if another authority disagrees with Australia's view.
