Boeing Investors Seek Rehearing of Class Certification Decision

Boeing investors have requested that the Fourth Circuit U.S. Court of Appeals reconsider its decision to reverse class certification in their securities fraud suit against The Boeing Co. and its former officials.

The lawsuit alleges that misstatements about the company's emphasis on safety artificially inflated Boeing's stock price, but the court previously ruled that the investors did not meet the necessary requirements for a class action lawsuit.

The plaintiffs are now asking the appeals court to rehear the case, arguing that the previous decision was extreme and would have far-reaching consequences for class action litigation in the circuit.
