Boeing Sued by LOT Polish Airlines Over Alleged Concealment of 737 MAX Risks

LOT Polish Airlines is suing Boeing in a Seattle federal court over the safety and handling of its 737 MAX aircraft. The airline alleges that Boeing knew about the risks of its Maneuvering Characteristics Augmentation System (MCAS) as early as 2016, but concealed this information from customers to avoid triggering simulator training requirements.

The lawsuit claims that in 2016, when LOT was evaluating aircraft for its fleet, Boeing representatives made false or misleading representations about the MAX's flight characteristics and training requirements. Specifically, they allegedly understated MCAS's authority and downplayed the risks of single-angle-of-attack sensor dependence.

The airline signed lease agreements based on these representations and later incurred substantial financial losses when the global MAX fleet was grounded in March 2019 due to two fatal crashes. LOT claims that Boeing's concealment of risks was deliberate, aimed at avoiding costly simulator training requirements that would have hurt the jet's sales.

The case is significant because it marks a departure from typical airline litigation, which often settles outside of court. By demanding a jury trial, LOT is pushing to have ordinary citizens evaluate Boeing's credibility and determine whether its representatives made promises they knew were false.
