Bombay High Court Slams Maharashtra FDA Over Excessive Actions Against Amazon Warehouse
The Bombay High Court recently criticized the Maharashtra Food and Drug Administration (FDA) for taking an excessive step against an Amazon warehouse in Bhiwandi. The court called the FDA's actions 'killing a mosquito with a sword,' implying that they were using too much force to address regulatory violations.
According to the source, the FDA conducted an inspection of the Amazon warehouse on June 24 and suspended its license the following day without serving an improvement notice. This led Amazon to file an appeal with the relevant authority, but the FDA issued a show-cause notice on July 1 and later canceled the warehouse's license.
The court questioned the appropriateness of shutting down businesses for regulatory violations, highlighting procedural concerns during an ongoing appeal. The judges observed that 'during the appeal period, no such action can be taken,' and that the FDA was trying to 'kill a mosquito with a sword.'
