EU Court Upholds Microsoft's Non-Gatekeeper Status for Edge Browser
The European Union's General Court has dismissed Opera Norway's challenge to Microsoft's non-gatekeeper designation under the Digital Markets Act. On September 2, 2026, the court upheld the European Commission's decision from February 12, 2024, not to designate Microsoft as a gatekeeper for its web browser, Microsoft Edge.
The decision followed market investigations by the Commission, which ruled that Microsoft Edge does not constitute an 'important gateway' within the meaning of the DMA. The court held that the Commission was entitled to rely on the low scale of usage of the browser and compare it with other browsers in assessing its importance as a gateway for business users.
The Digital Markets Act aims to ensure fair competition in the digital economy by regulating core platform services, such as online search engines and web browsers. Entities designated as gatekeepers are subject to certain obligations to promote fair market competition.
