FCC Lawsuit Interveners Claim Standing as Disney Objects
A pair of progressive groups and viewers of ABC stations have responded to Disney's opposition to their request to become plaintiffs in a federal lawsuit against the FCC.
The lawsuit, American Broadcasting Companies v. FCC, was filed by The Walt Disney Company over alleged retaliation from the FCC, which resulted in altered programming on ABC stations.
Frequency Forward and the Media Action Center, along with 14 individual viewers, claim that they have standing to intervene in the case because they have been harmed by the FCC's actions, including lost programming and changes in guest bookings.
The groups argue that Disney is not adequately representing their interests and that they need to be able to participate in the lawsuit to protect their First Amendment rights as viewers of ABC stations.
District Court Judge Loren L. AliKhan has deemed the motion to intervene 'ripe for decision' and will direct further briefing if necessary.
