Merck's Medicare Challenge Rejected by D.C. Federal Court

A federal court in Washington D.C. has ruled against Merck in its challenge to the Medicare drug price negotiation program, finding that the company's voluntary participation in federal drug programs precludes its constitutional takings claim.

The court rejected Merck's argument that the program infringes on its rights by limiting what it can charge for certain drugs. Instead, the court found that because Merck had chosen to participate in these programs voluntarily, it cannot now claim that the government's actions are unconstitutional.

Merck was seeking a $56M verdict in the biotech case, but this ruling may impact its chances of success in other areas as well.
