Nigerian Court Overturns PENGASSAN Chevron Branch Executive Committee Dissolution
A Nigerian court has ruled in favor of seven members of the Petroleum and Natural Gas Senior Staff Association of Nigeria (PENGASSAN), Chevron Branch, who challenged the dissolution of their executive committee and branch elections.
The Lagos Division of the National Industrial Court (NICN) nullified the dissolution of the executive committees, citing a breach of PENGASSAN's constitution. The court also invalidated an eight-member caretaker committee appointed by the union's Central Working Committee (CWC).
Justice Joyce Damachi ruled that the CWC lacked the constitutional authority to dissolve the branch executive without prior approval from the National Executive Council (NEC) and without following disciplinary procedures mandated by the union's constitution.
