Twitch and Amazon Sued Over Alleged Use of Streamers' Content for AI Training

A class action lawsuit has been filed against Twitch and Amazon, claiming that they used streamers' content to train their AI models without consent.

The lawsuit, brought by Warren Pandiscia, a streamer based in Connecticut, alleges that the companies breached their contract with streamers by using their content as 'free training stock for separate commercial AI products.'

Twitch and Amazon have previously stated that they would use streamers' content to train generative AI models, but only if users opted out. However, the lawsuit claims that this opt-out option was not clearly communicated to users.

In a recent Patch Notes stream, Twitch's chief product officer, Mike Minton, said 'if it was opt-in, nobody would opt in,' when asked about the lack of an opt-in system for AI training. The lawsuit argues that this statement suggests that the companies are aware that users would not consent to their content being used in this way.
