UnitedHealth Seeks Expedited Appeal on 401(k) Forfeiture Dispute
UnitedHealth Group Inc., a major health insurance provider, is seeking an expedited appeal of a decision that requires it to defend its 401(k) forfeiture practices. The company claims there's no clear guidance from circuit courts on this topic and that multiple appeals are pending.
In a motion filed with the US Court of Appeals for the Eighth Circuit, UnitedHealth argued that its case is an 'ideal candidate' for mid-case appeal because it raises broadly applicable legal questions that have led to varying results in federal district courts.
The company emphasized that even if the appeals court doesn't dismiss the case, their decision will influence the remaining litigation and guide future cases. UnitedHealth based this on its assertion of 'materially different results' in federal district courts due to a lack of circuit court guidance.
