UnitedHealth Seeks Fast Appeal of 401(k) Forfeiture Dispute Guidance
UnitedHealth Group Inc., a large healthcare provider, has requested an expedited appeal of a decision requiring it to defend its 401(k) forfeiture practices. The company argued that there is no clear guidance from circuit courts on this issue, with more than 10 pending appeals.
In a motion seeking interlocutory review by the US Court of Appeals for the Eighth Circuit, UnitedHealth stated that the dispute involves controlling legal questions with 'materially different results' in federal district courts. The company believes that its case is an ideal candidate for mid-case appeal due to the importance and breadth of these questions.
According to the motion, even if the appeals court does not dismiss the case, its decision will guide the remaining litigation by establishing a clear precedent on this issue.
