The US government has intervened in lawsuits against OpenAI and Microsoft, claiming that plaintiffs misunderstand the concept of fair use in copyright law.

In a statement filed with the US District Court for the Southern District of New York, the government argued that limiting the development of large language models (LLMs) under a narrow interpretation of fair use would harm national security and technological innovation.

The filing, which was dated September 2, 2026, stated that constraining LLM development would 'thwart creative and scientific progress while hindering American prosperity and economic mobility.'
